Terms of Service

Welcome to Perpetuate. These Terms of Use (“Terms”) govern your access to and use of the Perpetuate mobile application and website (collectively, the “Service”). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service.
By using the Service, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.
The Service is not available to individuals in jurisdictions where use of similar services is prohibited by law.

2. Nature of Service

Perpetuate is a self-development and lifestyle application designed to support personal growth, discipline, and identity transformation.
Perpetuate does not provide medical, psychological, or therapeutic advice. It must not be used as a substitute for professional healthcare, mental health treatment, or medical guidance.
Any goals, rituals, or personalised visions generated by the Service are for motivational purposes only.

3. Prohibited Use

You agree not to use the Service in any way that:

Encourages or incites violence, harm, or abuse towards yourself or others.
Generates or promotes sexually explicit, hateful, discriminatory, or illegal content.
Involves reverse engineering, data mining, or unauthorised access to the Service.
Attempts to exploit or harm minors.
Violates applicable laws in Australia, the United States, the United Kingdom, the European Union, or any other jurisdiction where the Service is available.

4. Subscriptions and Billing

Access to premium features requires an active subscription.
Subscriptions are billed through Apple App Store or Google Play Store using the payment method linked to your account.
All subscriptions auto-renew unless cancelled at least 24 hours before the renewal date.
You may manage or cancel your subscription through your App Store or Google Play account settings.
Fees are non-refundable except where required by law.
Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
Your account will be charged for renewal within 24 hours prior to the end of the current subscription period.
You can manage your subscriptions and turn off auto-renewal by going to your Account Settings in the App Store or Google Play after purchase.
If a free trial is offered, any unused portion will be forfeited when you purchase a subscription.

5. User Content

You may provide information, responses, and inputs (“User Content”) when using the Service.
You retain ownership of your User Content but grant Perpetuate a worldwide, non-exclusive licence to process, display, and use it for the purpose of operating the Service.
You are responsible for ensuring your User Content complies with these Terms and applicable laws.

6. Intellectual Property

All trademarks, software, graphics, audio, and other materials provided by the Service are the exclusive property of Perpetuate Life Pty Ltd or its licensors.
You may not copy, modify, or distribute any part of the Service without prior written consent.

7. Disclaimers

The Service is provided on an “as-is” and “as-available” basis.
Perpetuate makes no guarantees that use of the Service will result in achieving personal goals.
To the fullest extent permitted by law, Perpetuate disclaims all warranties, including fitness for a particular purpose and non-infringement.

8. Limitation of Liability

To the maximum extent permitted by law:

Perpetuate, its directors, employees, and affiliates will not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.
In jurisdictions where limitations are not permitted, liability will be limited to the amount paid for your most recent subscription period.

9. Termination

Perpetuate may suspend or terminate your account if you breach these Terms or misuse the Service.
You may stop using the Service at any time by deleting your account through the app or your App Store/Google Play account.

10. Governing Law and Dispute Resolution

For users located in Australia, these Terms are governed by the laws of Queensland, Australia.
For users located in the United States, these Terms are governed by the laws of Delaware, USA.
For users located in the United Kingdom and European Union, these Terms are governed by the laws of England and Wales.
For users located in any other jurisdiction, these Terms are governed by the laws of Queensland, Australia, without regard to conflict of law principles.

11. Changes to Terms

Perpetuate may update these Terms from time to time. Updates will be effective once published in the app or on our website. Continued use of the Service after changes indicates acceptance of the revised Terms.

Dispute Resolution

You agree to first attempt to resolve any dispute with us informally by contacting support@perpetuate.life.
If a dispute cannot be resolved informally within 30 days, it shall be resolved through binding arbitration rather than in court, except where prohibited by applicable law.
The arbitration will be conducted by a recognised arbitration body in the jurisdiction listed above, applying the governing law applicable to your region.
You waive any right to participate in a class action or class arbitration.
Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction to prevent unauthorised use or misuse of intellectual property.

You agree that any disputes will be subject to the exclusive jurisdiction of the courts in the relevant region above.
